Frequently Asked Questions...

If you're considering a Pre-Settlement Advance on your Auto Accident or Personal Injury Claim, or Advance Funding for your lawsuit, you may find these questions and answers, helpful.

Usually, your case qualifies for an advance, if: 1. The cause of the accident or injury was not your fault; 2. The other party has enough insurance coverage to pay your damages; and 3. You received a serious personal injury.

  1. How will a cash advance help me?

  2. What is the charge?

  3. Do I need good credit?

  4. Who is eligible?

  5. What papers do I sign?

  6. When is it paid back?

  7. What if I lose my case?

  8. How long does it take?

  9. Why is an advance different than a loan?

  1. How will a cash advance help me?

Many times, a cash advance will enable you to hold out for a larger settlement, giving the attorney time to get you the largest possible recovery. You will not be forced to take the first, low settlement offer because of financial pressure caused by the accident.

  2. What is the charge?

There is no charge for the cash advance if you meet our criteria. There are never any application fees, origination fees or other charges like many competitors.

  3. Do I need good credit?

No. Lawyers Funding makes cash advances based on the value of the claim not on a credit rating. There is no application fee, and no job is required.

  4. Who is eligible?

Anyone with a viable injury claim such as: a Vehicle Accident, Wrongful Death Case, Serious Injury Claim, Product Liability Claim, Premises Liability Claim, a Dog Bite, etc is eligible for a cash advance. They must be attorney represented, and there must be adequate insurance coverage.

  5. What papers do I sign?

The client and attorney sign a simple lien agreement. The agreement authorizes the attorney to pay us back from the recovery, and states he does not guarantee or co-sign for the advance.

  6. When is it paid back?

The advance is paid back upon settlement or recovery of the claim.

  7. What if I lose my case?

If you lose the case, you keep the advance and owe us nothing. The pay back is contingent upon getting a recovery on your claim.

  8. How long does it take?

The advance can usually be approved and money available within 72 hours of our receipt of the claim documentation.

  9. Why is an advance different than a loan?

An advance is based on the value of your case not on your credit. Unlike a loan it does not have to be paid back, unless you get a recovery and the fee for an advance is based on risk not interest.
