Lemon Law
Any vehicle that is defective is unofficially referred to as a 'lemon'. Before lemon laws were enacted used car buyers had no legal options if they found that their newly purchased cars needed extensive repairs, even if they were not told that this would be the case in advance. Although lemon laws have not been passed in all states, there are a number of consumer protection laws that regulate how private sellers and car dealerships can advertise and sell their vehicles. In some states, all car sellers are required to give their customers a 30 day warranty. If a buyer finds that there is anything wrong with his or her car then the vehicle can be returned to the seller and the sale will be voided. In other states, a car must pass inspection, have a clean title that can be registered in the name of the purchaser and have valid insurance.If a seller falsely advertises a vehicle in order to facilitate a sale then criminal charges can be brought up. Civilly, car dealers and private sellers can be liable for treble damages if they have caused their customers any type of inconvenience. There are many law firms nationally that take on lemon law cases. They analyze bills of sales for inconsistencies and misrepresentations. One of the most common breach of lemon law occurs when sellers alter car odometers in order to alter the total mileage on a vehicle, which can increase the blue book value of a used car considerably.
Because lemon laws vary from state to state is it important to know which rules are valid before it can be established whether or not a car dealer is at fault. Often, lemon law attorneys will ask their clients to file police reports in order to establish when the alleged violation occurred. The statements of the sellers as well as the statements of the reporting officers can be used to build a solid case against offenders. If a seller purposefully and willfully makes false statements in order to make a sale, and vehicle in question is involved in a collision then he or she can be sued by all parties involved in the car accident. While rare, these types of case can also lead to serious criminal charges if death or dismemberment occurs. Lemon law is not meant to protect consumers that fail to register their vehicles with DMV, do not have their cars inspected or fail to purchase car insurance in a timely manner.
